General terms and terms of sale

The present conditions of sale are concluded, on the one hand, by the company Hygeco International Produits with a share capital of €1,000,000, whose registered office is located at 12-16 rue Sarah Bernhardt 92600 Asnières-Sur-Seine, registered in the Nanterre Trade and Companies Register under number 377 652 938, hereinafter referred to as "HYGECO", and which manages the website www.shop.hygeco.com, and, on the other hand, by any individual or legal entity wishing to proceed with a purchase via the website www.shop.hygeco.com, hereinafter referred to as the "buyer".

Article 1. Purpose

The present conditions of sale aim at defining the contractual relations between HYGECO and the buyer and the conditions applicable to any purchase made through the website www.shop.hygeco.com. The acquisition of a product through the present site implies an unreserved acceptance by the buyer of the present conditions of sale which the buyer acknowledges having read prior to his order. Prior to any transaction, the buyer declares to have full legal capacity, allowing him/her to commit to the present general sales conditions.

HYGECO reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulation or in order to improve the use of its site. Therefore, the applicable conditions shall be those in force at the date of the order by the Buyer.

Article 2. Products

The products offered are those which appear on the www.shop.hygeco.com website of the company HYGECO, within the limit of available stocks. The company HYGECO reserves the right to modify at any time the assortment of products. Each product is presented on the Internet site in the form of a description of its main technical characteristics. The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented on the website www.shop.hygeco.com is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Prices

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) excluding taxes (HT). The VAT rate applicable on the day of the order is displayed in the "Order Summary" box on the "Checkout and Payment" page. Any change in the VAT rate may be reflected in the price of the products. HYGECO reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order shall be the only one applicable to the buyer. The prices indicated do not include the delivery costs, which shall be invoiced in addition to the price of the products purchased according to the total amount of the order.

Article 4. Order and payment terms

Before placing an order, the buyer must create an account on the website www.shop.hygeco.com. The account creation section is accessible directly from the side menu bar. At each visit, the Buyer, if he wishes to order or to consult his account (status of orders, profile...), shall identify himself using this information. HYGECO proposes to the Buyer to order and pay for its products in several steps, with 3 payment options to choose from:

- Payment by bank transfer on the due date of the invoice if the Buyer has opened an account with HYGECO: the Buyer selects the products he/she wishes to order in the "shopping cart", modifies if necessary (quantities, references...), verifies the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer. Then, the buyer chooses the payment method of his choice: "Payment by bank transfer". Finally, the last step offers the buyer to check all the information, to read and accept the present general terms and conditions of sale by ticking the corresponding box, and then invites the buyer to validate the order by clicking on the "Confirm my order" button. This last click constitutes the final conclusion of the contract. As soon as the order is validated, the buyer receives an order form confirming the registration of his/her order.

- Secure payment by credit card: the buyer selects the products he/she wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by card". The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface in order to safely enter their credit card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable.

- Payment by SEPA direct debit: the buyer selects the products he/she wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by SEPA". The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to validate the order by clicking on the "Pay with SEPA" button. Finally, the buyer is redirected to the secure interface in order to safely enter the bank details of the account to be debited. If the direct debit is accepted, the order is recorded and the contract is definitively formed.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke its own terms and conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the Buyer has an e-mail address and if he/she has provided it on his/her order form, HYGECO shall send him/her by e-mail the confirmation of the registration of his/her order.

Article 5. Reservation of Ownership

HYGECO shall retain full and complete ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Guarantee

All products supplied by HYGECO shall benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to HYGECO which shall take it back, exchange it or refund it. All claims, requests for exchange or reimbursement must be made by post to the following address HYGECO, 12-16 rue Sarah Bernhardt 92600 Asnières-Sur-Seine, within thirty days after delivery.

Article 7. Responsibility

HYGECO, in the distance selling process, is only bound by an obligation of means. Its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

Article 8. Intellectual property

All elements of the www.shop.hygeco.com website are and remain the exclusive intellectual property of HYGECO. No one is authorised to reproduce, exploit or use in any way whatsoever, even partially, elements of the site whether they are in the form of photo, logo, visual or text.

Article 9. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. The delivery times are only given as an indication; if they exceed thirty days from the order, the sale contract may be cancelled and the buyer reimbursed. HYGECO may provide the Purchaser by e-mail with the tracking number of its package. The risks related to transport shall be borne by the purchaser as from the moment the articles leave the premises of HYGECO. The buyer shall verify in the presence of the carrier or the delivery person, the state of the packaging of the goods and its content upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 10. Personal Data

HYGECO undertakes to preserve the confidentiality of the information provided by the buyer, which he/she would be led to transmit for the use of certain services. Any information concerning the purchaser is subject to the provisions of the law n° 78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him/her. Article 11. Settlement of Disputes

The present conditions of distance selling are subject to French law. For any dispute or litigation, the competent court shall be that of Nanterre.
